How to Get a Delaware Medical Marijuana Card

The Delaware Department of Public Health offers a mail-in application in order to receive a Medical Marijuana card.

Who is eligible?

To be approved for a Delaware Medical Marijuana card you must be a resident of Delaware and 18 years of age or older, or have a designated caregiver complete the application process and receive consent from both parents or guardians. The patient has to be diagnosed with one of the following conditions:

  • Terminal Illness
  • Cancer
  • HIV or AIDS
  • Decompensated cirrhosis
  • ALS
  • Agitation of Alzheimer’s disease
  • PTSD
  • Intractable epilepsy
  • Autism with self-injurious or aggressive behavior
  • Cachexia (wasting syndrome)
  • Severe pain that has not responded to medication for more than three months
  • Severe Nausea
  • Seizures
  • Severe and persistent muscle spasms, like those from Multiple Sclerosis

If the patient is a minor they must be diagnosed by a Pediatric Neurologist, Gastroenterologist, Oncologist, or Palliative Care Specialist with one of these conditions:

  • Intractable epilepsy
  • Cachexia (wasting syndrome)
  • Intractable nausea
  • Severe, painful, persistent muscle spasms

How much does it cost?

$125.00 for all applications or renewals. The state also offers a Fee Waiver Request that reduces the fee based on the Gross Annual Household Income.

How do I apply?

Apply for a medical marijuana card in Delaware by completing these steps:

  1. Fill out the Patient Application Form or Pediatric Patient Application Form and Caregiver Form if applicable
  2. Visit with your physician and have them fill out the Physician Certification section. The patient’s application must be received within 90 days of your physician’s signature date.
  3. Provide a copy of your state-issued identification or driver’s license
  4. Include the application fee payment (made payable to “State of Delaware, MMP”) and Fee Waiver Request with documentation if applicable
  5. Mail all documents to the Medical Marijuana Program office
